1. Acceptance of Terms
By accessing or using the QuantumRand API, SDKs, dashboard, or any related services (collectively, the "Service") provided by Noel Innovations LLC, doing business as QuantumRand ("QuantumRand," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
If you do not agree to these Terms, do not use the Service.
2. Description of Service
QuantumRand provides a quantum entropy API that delivers random numbers and cryptographic primitives generated from a quantum entropy source — Qiskit Aer quantum circuit simulation by default, with quantum hardware backends available on paid plans when active. The Service includes:
- Core entropy endpoints (hex, integer, float, bytes, UUID)
- Financial primitives (transaction IDs, OTPs, nonces, keypairs, audit signatures)
- Industry-specific endpoints for fintech, gaming, healthcare, legal, cybersecurity, and IoT applications
- Audit logging and compliance dashboard
- SDKs for Python, JavaScript, and Go
The Service is provided on a subscription basis with a free tier and paid tiers as described at quantumrand.dev/pricing.
3. Third-Party Infrastructure Dependency
The Service relies on third-party quantum hardware providers to generate quantum entropy. QuantumRand does not operate quantum hardware directly.
3.1 Entropy Source Disclosure
All API responses include an entropy_source field indicating whether entropy was generated by quantum hardware ("quantum"), a blend of quantum and software entropy ("hybrid"), or software-based CSPRNG fallback ("fallback"). QuantumRand will never misrepresent the source of entropy delivered.
3.2 Service Availability
QuantumRand's ability to deliver quantum entropy depends on the availability of quantum hardware systems. During periods of quantum hardware unavailability, the Service may automatically fall back to hybrid or software-based entropy generation. QuantumRand is not liable for quantum hardware downtime or degraded availability.
3.3 No Affiliation
QuantumRand is not affiliated with, endorsed by, or officially partnered with any quantum hardware manufacturer. Use of quantum hardware is subject to the respective provider's terms of service.
4. Account Registration and API Keys
- You must provide accurate information when creating an account
- You are responsible for maintaining the security of your API key
- API keys must not be shared, published publicly, or committed to source control
- You must notify us immediately at security@quantumrand.dev if you suspect unauthorized use of your API key
- We reserve the right to revoke API keys that are compromised or used in violation of these Terms
- One free account per person or organization — creating multiple free accounts to circumvent rate limits is prohibited
5. Acceptable Use
5.1 Permitted Uses
You may use the Service for any lawful purpose, including commercial applications, provided you comply with these Terms and all applicable laws.
5.2 Prohibited Uses
You may not use the Service to:
- Generate entropy for use in weapons, malware, ransomware, or any destructive software
- Facilitate fraud, money laundering, or any illegal financial activity
- Violate any applicable law or regulation including export control laws
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Resell or sublicense API access without written authorization from QuantumRand
- Circumvent rate limits, authentication, or any access controls
- Use the Service in any application involving weapons systems or military targeting
- Collect or harvest user data from the Service beyond what is necessary for your application
6. Billing and Payment
6.1 Subscription Tiers
The Service is offered on the following tiers: Free ($0/mo), Indie ($9/mo), Startup ($49/mo), Business ($299/mo), and Enterprise (custom pricing). Tier features and rate limits are as described at quantumrand.dev/pricing and may be updated with 30 days notice.
6.2 Payment Processing
All payments are processed by Stripe, Inc. By providing payment information you agree to Stripe's terms of service. QuantumRand does not store payment card data.
6.3 Billing Cycle
Subscriptions are billed monthly on the date of initial subscription. Upgrades take effect immediately and are prorated. Downgrades take effect at the end of the current billing period.
6.4 Payment Failure
If payment fails, QuantumRand will retry for 3 days. After 3 days of failed payment, your account will be downgraded to the Free tier. Service is restored immediately upon successful payment.
6.5 Cancellation
You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.
6.6 Refunds
Refunds are issued at QuantumRand's sole discretion. To request a refund contact billing@quantumrand.dev within 7 days of charge.
7. Rate Limits and Fair Use
Rate limits are enforced per API key based on your subscription tier. Exceeding rate limits will result in HTTP 429 responses. Sustained abuse of rate limits may result in account suspension. Enterprise customers may negotiate custom rate limits.
8. Service Level Agreement
8.1 Free Tier
No uptime guarantee is provided for Free tier accounts. The Service is provided as-is.
8.2 Paid Tiers
QuantumRand targets 99%+ API availability for paid tier accounts. This target excludes scheduled maintenance (announced 48 hours in advance), quantum hardware unavailability, and events outside QuantumRand's reasonable control.
8.3 Enterprise SLA
Custom SLA terms including uptime guarantees, support response times, and remedies are available for Enterprise customers under a separate agreement.
9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy at quantumrand.dev/privacy. Key points:
- Entropy values generated for your account are not stored after delivery
- Private keys generated by /v1/finance/keypair are shown once and never retained by QuantumRand
- API call logs are retained for 12 months and are accessible in your dashboard
- Account data is stored in Google Cloud Firestore in the United States
10. Healthcare and HIPAA
Customers using the Service for applications subject to the Health Insurance Portability and Accountability Act (HIPAA) must execute a Business Associate Agreement (BAA) with QuantumRand prior to processing any Protected Health Information (PHI). BAAs are available for Business tier and above. Contact legal@quantumrand.dev to request a BAA.
11. Intellectual Property
The Service, including all software, documentation, APIs, and SDKs, is owned by Noel Innovations LLC and protected by copyright, trademark, and other intellectual property laws. The QuantumRand name and logo are trademarks of Noel Innovations LLC.
Open-source SDKs (Python, JavaScript, Go) are licensed under the MIT License as indicated in their respective repositories. The core API, backend infrastructure, and proprietary algorithms are All Rights Reserved.

14. Indemnification
You agree to indemnify, defend, and hold harmless Noel Innovations LLC, its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
15. Termination
QuantumRand may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or any activity that QuantumRand determines poses a risk to the Service or other users. You may terminate your account at any time by contacting support@quantumrand.dev.
Upon termination, your right to use the Service ceases immediately. Sections 11, 12, 13, 14, and 17 survive termination.
16. Modifications to Terms
QuantumRand reserves the right to modify these Terms at any time. Material changes will be communicated via email to registered account holders at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved by binding arbitration in New York, New York under the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
